1. Regarding this work order, the Customer and Gunsmith agree to the following:

a. The Gunsmith shall complete the gunsmithing request as per the Work Order.

b. The Gunsmith reserves the right to refuse any Work Order request for any reason. The Customer will be notified in writing of the refusal and parts will be returned to the Customer in the condition received.

c. The Customer is informed that any alterations to the gun as originally manufactured may release the Manufacturer from any liability for any accident should any occur and may void any Manufacturer warranty.

d. The Customer acknowledges by requesting and signing this Work Order, that he is also releasing the Gunsmith, both individually and in any business form, from any liability should any accident occur because of the requested changes or alterations.

e. The Customer will release the Gunsmith from all liability for any loss, damage or injury to persons or property resulting from the work requested in this Work Order, without limitation, whether or not resulting from the negligence of the Customer or Customer's agent.

f. Turnaround times are approximate and not a guarantee. We will do our best to complete your job in a timely manner but sometimes circumstances beyond our control may extend a jobs turnaround time. Additions to this work order may extend turnaround time also. 

g. This agreement supersedes all other agreements either oral or in writing, between the Customer and the Gunsmith with respect to the subject of this contract. This contract contains all of the promises and agreements between the parties with respect to the gunsmithing work requested on the Work Order. No Agreement, statement or promise not contained in this contract shall be binding or valid.

h. No money is required up front on jobs except Special orders require a non-refundable down payment in the amount of 50% of the price of the item, with the balance payable once the order is shipped to you.

 Payment in full for all labor and parts is due 30 days from notification of job completion. Any jobs left in the shop for more than 30 days after written notification will be sold to cover expenses.

i. The Gunsmith does not warranty new or used parts utilized in the undertaking of the Work Order. Many USGI parts are more than 50 years old. Every attempt is made to ensure high quality parts but on guns of this age that have been through several wars anything is possible.

j. All firearms received will be mailed directly back to the person and address it was sent from. If it must go to a different person then it must be sent to an FFL dealer in your area for legal transfer. All firearms must be sent with adult signature required. Handguns must be sent overnight in accordance with federal law.

k. The customer is responsible for knowing his own state and local laws concerning the firearms being worked on. For example if you know a flash hider is illegal in your area then don't ask me to install one.

l. All correspondence regarding the rifle, once received, is recommended by phone with a follow-up email.  Emailing alone can be unreliable and miscommunications can result.  Upon receipt of the firearm and this work order, we will provide the customer with our private cell phone number to ensure communication.

 

 

 

 

2. Agreement and Release From Liability

As the Customer, I acknowledge that I have voluntarily requested  West Texas Armory to execute the activities and modifications specified on the Work Order which may affect various safety systems of the firearm.

3. Assumption of Risk

I am aware that alterations and modifications of guns may be hazardous and that using a firearm that has been modified may result in injury and death. I am further aware that ANY time I handle a firearm in ANY way, the UNLOADED firearm should be pointed in a safe direction and all safety features should be checked BEFORE EACH firing. I am aware that if I do not know how to check the safety features of the firearm, I should contact the manufacturer.

I am voluntarily requesting that these modifications be made and I hereby agree to accept any and all risks of injury or death. My signature below indicates that I have read, understand and agree to abide by all of the provisions in this contract on this contract.

I hereby agree that I, my assignees, heirs, distributees, guardians and legal representatives, will not make a claim against, sue or attach the property of West Texas Armory, or any of its affiliated organizations, for injuries or damages resulting from negligence or other acts how so ever caused by West Texas Armory, or any employee, agent or contractor of West Texas Armory, or any of it's affiliated organizations as a result from my request for modification or alteration to a firearm.

I hereby release West Texas Armory and any of its affiliated organizations from all actions, claims or demands that I, my assignees, heirs, distributees, guardians or legal representatives now have or may hereafter have for injuries or damages resulting from my request of modification or alteration to a firearm set forth in this Work Order.

Payment, Return & Service Policy  
Payment Options & Policy
Visa, Master Card, Discover, American express, Cash, Check, or Money order only. Do not mail cash.  Payment is due NO later than 30 days after notification that work to be performed is complete. Failure to do so will result in the work piece or gun will be sold to cover the amount owed.

NO refunds on special order items. Any other items returned for refund will be inspected and refunded upon receipt minus a 20 % restocking fee unless we sent the part in error.


Work Order Reservations
Since I am a one man operation I strive to operate on a 1st come 1st serve basis. To keep you from having to part with your prized gun for a long period of time while waiting to be repaired: I offer work order reservations that is secured on a specific date by a nonrefundable payment of $35.00. 7 days before the date specified I will contact to remind you & give you ample time to get your gun in the mail to me. Once I have your gun I will do my inspection & contact you with in a day or two to discuss the details regarding your gun. The reservation payment will go towards your ending balance or will cover your balance due. Call to set-up a date & promptly mail your payment to me or charge by card to secure it.


Guarantee / Warranty

I guarantee my workmanship will be free of any defects for as long as the customer owns said firearm. However I am not completely perfect. Should you ever have any problems I will be happy to correct them at no charge. This does not include obvious abuse or honest wear. If you choose to have anyone else work on a firearm after you receive it back from us then I will not be held responsible for any damages or problems that may occur. Example: If I assembled a new barrel to your rifle then you have some other gunsmith remove the barrel and then reinstall it incorrectly, resulting in a misindex or any other problem,  it is now your problem along with the other gunsmith and any and all warranties from me are voided.

We can not and will not be held responsible for the use of improper ammunition or handloads of any kind. Handloading practices are beyond my control and are soley the responsibility of the user.  

Turnaround times

Current turnaround times are between 3 and 6 months. Some jobs may be longer depending on special order items such as McMillan stocks.  My main goal is quality, not speed.  Turnaround times are only approximate and not a guarantee.

Contacting us

Due to the ever increasing amount of emails we receive please allow about 1 week in some cases for a response. We are a small business and it is only me and my wife running it. We do our best but I have to get work done in the shop. My wife answers the phone and emails normally but if she is not here it may take a while.

Shipping to us

To ship guns to us please use UPS or Fedex. Do NOT go to a UPS store or mailboxes etc. It is against their policy to ship guns. It must be taken to a ups or fedex terminal. The US post office can ship rifles also but I don't recommend it. You can ship the gun directly to us and we can mail it directly back to you when complete. There is no need to have another dealer on your end send it. Federal law allows a person to mail a firearm directly to a gunsmith or manufacturer for repair. Guns should NOT be shipped in inexpensive plastic gun cases.

 

Return Policy

To ensure your complete satisfaction, we offer a very liberal 30-day return policy for exchange or full refund (with few exceptions that are noted below).

Please, follow this simple procedure returning the products that may have been damaged in transit, defective, shipped by error or simply something you do not like.

Return Procedure
Products may be returned for refund or exchange within 30 days from delivery date. To qualify for a refund products must be undamaged, in new, salable condition, in their original boxes, with all original accessories and/or documentation and have an RA# (Return Authorization #) issued by us. For RA# simply call (806)-842-3856 during  our business hours and explain to us why you are unhappy.

We will issue a full refund (less S/H) or send you a replacement within 30 business days after we received the returned item. Please, note that we will be unable to accept any returns without RA#, no exceptions.

The following items are not subject to return, refund or exchange:

- Shipping and Handling charges
- Special Order items. Special Order is defined as an item which is not regularly stocked by West Texas Armory or custom built items such as rifles with McMillan or fancy grade stocks and other items that we order for you per your special request.
- Items ordered in unusually high quantities (more then 10 pieces of same item)

Credit will be issued back to the credit card if payment was made using credit card, or company check will be mailed to you if any other payment method was used, within 30 days after we received the returned item authorized for refund.

 

Damaged in Transit
Each product is thoroughly inspected and carefully packed before leaving our warehouse in accordance with the carrier’s guidelines. Should you receive the product in a damaged condition, apparent or concealed, you must retain the damaged product and all packing materials and report it to us within 48 hours of delivery so that we can file the claim with the carrier and send you replacement or issue a full refund and/or arrange for returning the damaged product to us.

We will not be able to accept any returns of products damaged in transit after 48 hours of delivery, no exceptions!

We are in no way responsible for items damaged in transit to us. You are responsible for properly packaging and insuring your items such as rifles or parts when they are shipped to us. 

 

Order Cancellations
You may cancel your order of regular stock items at any time prior to shipment by us. Once an item has been shipped, you will have to return it in accordance with our Return Policy. Special orders can only be cancelled if the order has not yet been placed with our vendor. Any deposits given for special order items (including custom built rifles and gunsmithing work) are nonrefundable if you decide to cancel the order for any reason. If we decide to cancel your order you will be issued a refund unless it was for a reason where we find out you were trying to illegally purchase the item or had any intentions other than honorable toward us or in the use of the item you wished to purchase.

Any attempts to illegally purchase a firearm or any other item from us or to break any law or to express the intent to break any law with our products will be reported to the appropriate federal and/or local law enforcement agency.

Illegal actions include but are not limited to:

 straw purchasing: buying a firearm or controlled item for any other person, whether a known felon or not.

attempting to purchase items known to be illegal in your area.

Not being of legal age to purchase the item.


Special Orders
Special Order is defined as an item which is not regularly stocked by us and that we order for you per your special request, or the items that we decided to offer in order to provide you with the widest selection possible. The normal lead time for special orders varies greatly depending on what it is. We will keep you updated on the status of the order, but we can not be held responsible for any extended delay caused by our vendors.
Special orders require a non-refundable down payment in the amount of 50% of the price of the item, with the balance payable once the order is shipped to you. You will have 30 days from the date you are notified the item is ready to ship (unless prior arrangements are made in writing with us) to submit payment in full or the item will be sold to cover our costs.

 Special Order items are not subject to return for refund or exchange.
